What kinds of video content can I upload?

All videos on MEINL percussion must comply with our Terms of Use. For further information, please see our Community Guidelines (http://meinlpercussion.com/no_cache/community/help_center/community_guidelines.html).

How do I file a DMCA complaint?

Copyright Infringement Notification
To file a copyright infringement notification with us, you will need to send a written communication that includes substantially the following (please consult your legal counsel or see Section 512(c) (3) of the Copyright Act to confirm these requirements):
1.    A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2.    Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site is covered by a single notification, a representative list of such works at that site.
3.    Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
4.    Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
5.    A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6.    A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please also note that under Section 512(f) any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.
If there are many videos to be removed, or you expect to have an ongoing need to remove potentially infringing content from MEINL percussion, we suggest that you sign up for our Content Verification Program which electronically notifies us, removing any room for error, and significantly increases the speed at which we are able to remove any infringing content.

Counter-Notification

If you elect to send us a counter notice, to be effective it must be a written communication provided to our designated agent that includes substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements:

1.    A physical or electronic signature of the subscriber.
2.    Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
3.    A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
4.    The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability. Please also be advised that we enforce a policy that provides for the termination in appropriate circumstances of subscribers who are repeat infringers.

Why was my video taken down?

Your video was taken down, after a review by MEINL percussion staff, because of either inappropriate content or copyright violation, as defined by our Terms of Use. Please review the MEINL percussion Community Guidelines (http://meinlpercussion.com/no_cache/community/help_center/community_guidelines.html) for more information on how to stay out of trouble on MEINL percussion.

How do I report copyright infringement?

If you are the copyright owner of a video and wish to report content being used without your permission, please follow these directions to submit a copyright infringement notice.

To file a counter notification with us, you must provide a written communication that sets forth the items specified below. Please note that you will be liable for damages (including costs and attorneys' fees) if you materially misrepresent that a product or activity is not infringing the copyrights of others. Accordingly, if you are not sure whether certain material infringes the copyrights of others, we suggest that you first contact an attorney.

Please understand that filing a counter notice may lead to legal proceedings between you and the complaining party to determine ownership, and if your claim is rejected, you may face severe legal and financial penalties.

To expedite our ability to process your counter notification, please use the following format (including section numbers):

1. Identify the specific URLs of material that MEINL percussion has removed or to which MEINL percussion has disabled access. Include the username of your MEINL percussion account as well.
2. Provide your name, address, telephone number, email address, and a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or San Francisco County, California if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
3. Include the following statement: "I swear, under penalty of perjury, that I have a good faith belief that each search result or message identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
4. Sign the paper.
5. Send the written communication to the following address:

I recorded my video at a sporting event, concert or from television or a DVD. Recording a television show, sporting event, concert, or clips from a purchased DVD onto your computer doesn't necessarily mean that you own all necessary rights in that video to upload it to MEINL percussion. Even if you never claimed to own the copyright or gave the copyright owner credit, posting these videos on MEINL percussion may violate copyright law.For more information, visit our Copyright Tips page.

What are you doing to prevent unauthorized copyrighted content from appearing in MEINL percussion?

Since all content on MEINL percussion is posted by our users, we make it clear in our terms of use and at the time of upload that they must own the copyright to the videos they post or have permission from the copyright holder. We encourage copyright holders to report any specific infringing videos via the DMCA takedown process (http://meinlpercussion.com/no_cache/special/privacy_policy.html). User accounts of repeat infringers are automatically terminated.

What if I believe I have been falsely accused of copyright infringement?

If you feel a content owner has misidentified your content as infringing, you may file a DMCA counter-notification.

What is your policy on copyright infringement?

MEINL percussion respects the rights of copyright holders and publishers and requires all users to confirm they own the copyright or have permission from the copyright holder to upload content. We comply with the Digital Millennium Copyright Act (DMCA) and promptly remove content when properly notified. Repeat infringers' videos are removed and their accounts are terminated and permanently blocked from using MEINL percussion. Why was my video removed for copyright while similar videos were not?

When we are notified or otherwise become aware that a particular video uploaded to our site infringes another's copyright, we respond promptly, as the law requires. If there remain videos on the site that appear similar to the one(s) we've removed, we are likely either not aware of them or do not have reason to believe they are infringing. Sometimes a copyright owner authorizes some, but not all, of its works to appear on our site. Other times, very similar videos are owned by different copyright owners, and one may grant permission while another does not.
